Erik Menendez Hospitalized, Lawyer Calls for Release

Erik Menendez, known for his involvement in the notorious case alongside his brother Lyle, has reportedly been hospitalized. The brothers were implicated in the 1996 murders of their parents, José and Kitty Menendez. Recently, Erik’s lawyer has requested his release ahead of a parole hearing set for next month.

Mark Geragos, Menendez’s attorney, informed TMZ on Tuesday that Erik is suffering from a “serious condition.” While specifics about his health were not initially disclosed, it was later revealed that he is being treated for kidney stones.

“It’s a serious condition,” Geragos stated, emphasizing the urgency of the situation.

He also urged California Governor Gavin Newsom to grant Menendez parole furlough before the hearing. Geragos believes this would allow Erik to better prepare with his parole attorney.

“I just think he should be parole furloughed… so that he can work with the parole attorney and get up to speed,” he explained. “I think that it’s the only fair and equitable thing to do.”

On May 13, a Los Angeles County Superior Court judge altered the sentences of both Erik and Lyle Menendez from life without parole to 50 years to life. The brothers have previously admitted to the killings, claiming they acted in self-defense due to years of abuse from their father, a statement that has sparked much controversy.

“I killed my mom and dad. I make no excuses and also no justification,” Lyle said in court, reflecting on the profound impact of their actions.

Prosecutors, however, contend that the brothers had premeditated the attack to gain access to their parents’ wealth, which complicates their case for release.

During the May hearing, the brothers emotionally addressed the court via video, requesting reconsideration of their fate. Anamaria Baralt, a cousin of the Menendez brothers, also spoke in support of them, advocating for a second chance.

“It’s been a nightmare,” she shared. “I am desperate for this process to be over.”

The case has gained renewed attention following a Habeas Corpus petition filed by the brothers’ legal team, suggesting new evidence might warrant a new trial. This includes a letter from Erik, written before the murders, mentioning alleged ongoing molestation and a claim by Roy Rosselló, a former member of the band Menudo, who alleged that José Menendez abused him as well.

In late 2024, the support of former LA District Attorney George Gascón for a resentencing recommendation gave the brothers hope. However, after Gascón’s electoral defeat, the new district attorney, Nathan Hochman, reversed that recommendation, leaving their future uncertain.
