Trial Date Request in Charlie Kirk Murder Case
Erika Kirk is asking a judge to reject a proposal from the defense that would delay the trial of her husband’s alleged killer until 2029. Instead, she is urging the court to set a trial date for 2027.
In a recent filing, Kirk’s legal team criticized the defense’s suggested timeline, deeming it “grossly out of line” compared to similar cases. They are pushing for the court to schedule the trial at the earliest possible date in 2027.
Furthermore, the legal representatives argued that more delays would only exacerbate the emotional burden on her family, especially on Charlie Kirk’s two young children, who were ages three and one when their father was killed. By the time a decision is reached under the defense’s timeline, the children would be seven and five. “Every additional day of delay carries the weight of all that Charlie’s murder has taken from his family,” the filing states.
Judge’s Remarks on Capital Charge
Kirk’s attorneys pointed out that Utah law ensures crime victims have a right to a prompt resolution of charges without unnecessary postponements. They also requested that the court mandate monthly updates or status conferences, emphasizing that the family’s needs should be considered before any potential scheduling extensions.
The defense for Tyler Robinson suggested a provisional trial start date in the latter part of 2029. They argued that setting a definitive date too early could lead to “false precision,” possibly jeopardizing Robinson’s constitutional rights in a case where the stakes are notably high. The defense underscored the intricacy of jury selection and the amount of evidence yet to be processed.
“Handling a capital case involves numerous responsibilities that you won’t find in any other situation,” the defense memorandum explained.
Pre-Trial Hearing Developments
Robinson’s attorneys stated they need more time to review evidence pertinent to both the guilt and possible sentencing aspects before the trial can commence. They believe that setting a firm date now would create unrealistic expectations and put undue pressure on both the court and the parties involved.
The prosecution anticipates being ready for trial by October 4, 2027, but Utah County Attorney Jeffrey S. Gray cautioned that starting then could mean the trial extends into the Thanksgiving and Christmas seasons, which could complicate proceedings.
Proposed Start Date and Expected Duration
Ultimately, the state proposes a trial start date of January 31, 2028. Prosecutors estimate that the trial would last around 17 weeks, while the defense expects it could take up to six to seven months.
In September 2026, 23-year-old Robinson was indicted on seven charges, including aggravated murder, following the fatal shooting of Charlie Kirk during a Turning Point USA event at Utah Valley University on September 10, 2025. If convicted, Robinson faces the possibility of the death penalty.
