Ex-ICE Director Teaches Democratic Mayor About Law After Calling for ‘ICE-Free Zones’

Chicago Mayor’s Actions Criticized for Violating Federal Law

A former director of the U.S. Immigration and Customs Enforcement Agency (ICE) stated on Monday that Chicago’s Democratic Mayor, Brandon Johnson, has breached federal law and the Constitution with his recent measures to challenge immigration law enforcement.

Johnson implemented an executive order establishing a so-called “iceless zone” in Chicago, asserting that “dramatic action” is required following an incident where federal agents faced ambush, prompting Chicago police to refrain from intervening. Jonathan Fahey, the former ICE director, explained to Fox News host John Roberts that Johnson’s orders are overshadowed by the constitutional supremacy clause.

“Generally, cities look forward to collaborating with federal authorities on crime matters. For instance, D.C. Mayor Bowser eventually embraced federal assistance, and I believe that has had positive outcomes. However, Johnson’s new executive order is quite unexpected, as it breaches two federal laws. It’s essentially obstructing federal enforcement,” Fahey remarked.

He added, “The irony is that, despite being a demand for enforcement, his order is not only illegal but also unenforceable under the Constitution. It seems to be just another political play, and honestly, I’m not sure he fully grasps the potential consequences of his actions.”

In recent months, ICE facilities in Chicago, as well as in Oregon and Portland, have experienced numerous protests against agency operations aimed at curbing illegal immigration. A video emerged online showing crowds in Chicago pushing for ICE agents to be arrested or harmed during one of the protests.

Tragically, a shooting occurred at the Dallas ICE office on September 24, resulting in two fatalities, including the gunman who took his own life. In Texas, a Border Patrol facility has witnessed violence, with ten individuals charged with attempted murder connected to incidents since July 4.
