Legal experts believe that Matt Kalil is unlikely to succeed in his lawsuit against his ex-wife, Haley Bailey, regarding her comments about his penis size.
Gregory Doll, a Los Angeles attorney, stated, “There’s almost no chance this case will go to court. It will likely either be dismissed or end in a settlement,” which could prove challenging.
Regarding Kalil’s claims about privacy, Doll noted that the allegations may meet certain criteria, but both parties are considered “public figures,” even if Kalil asserts that he has stepped back from public life.
Doll mentioned, “There could be First Amendment issues concerning Haley’s right to discuss her sex life publicly.” He added that she’s not the first celebrity to speak about such topics, and there aren’t strict rules making it off-limits.
On the topic of his unjust enrichment claim, Kalil’s legal team anticipates that the judge will assess whether Bailey is financially benefiting from the situation and if he deserves a share of any profits.
Doll explained that Bailey’s significant social media following—over 30 million—might have been bolstered by this incident. Interestingly, he speculated that Kalil’s lawsuit could actually amplify her audience further.
Doll also touched on Kalil’s possible motivations, highlighting his marriage to a social media influencer and his new family, suggesting he might want to keep private matters under wraps.
Nevertheless, he pointed out that if privacy is genuinely a concern, a cease-and-desist letter would be the more typical first step, and only then consider a lawsuit if the issue persists after that.
There’s no indication in the complaint that a cease-and-desist letter was issued to Bailey.
Another attorney, Adam Michael Sax, agreed that there seems to be little momentum in Kalil’s case, emphasizing that being a public figure doesn’t disappear with retirement.
The communication from Bailey’s representative was not available immediately.
Kalil’s lawsuit includes claims of invasion of privacy and unjust enrichment. He alleged that Bailey’s comments during a Twitch stream have led to “disturbing” messages impacting his current wife, Keilani Asmus.
During the stream in November 2025, Bailey alleged that Khalil’s penis size contributed to their 2022 divorce, making some bold statements about their attempts to save their marriage.
She humorously likened his size to “two Coke cans stacked together,” and described their marriage struggles, noting the extreme challenges they faced.
Kalil is asking for $75,000 in damages. He claimed that Bailey’s public remarks have led to unwanted attention and humiliating comments directed toward him and his family.
In a legal filing, he described the comments as “degrading” and said they caused severe emotional distress and damage to his reputation.
Bailey has not yet formally responded to the lawsuit. However, she expressed her shock and hurt at the situation, emphasizing the mentally taxing nature of litigation and voicing concern for their families involved.
Kalil’s attorney reiterated that Bailey publicly shared personal details about him for her own financial gain, which they deemed inappropriate and harmful to Kalil’s reputation and well-being.
The couple married in 2015 before eventually divorcing due to “irreconcilable differences” after seven years.
