Fulton County District Attorney Fani Willis has asked Georgia to reinstate six original criminal counts against former President Trump and his co-defendants in a 2020 election lawsuit after a judge dismissed the charges earlier this year. asks the state appellate court.
Mr. Willis filed a brief with the Georgia Court of Appeals asking that Fulton County Judge Scott McAfee's decision to dismiss charges against Mr. Trump and his allies be reversed. First reported by Atlanta Journal-Constitution Wednesday.
Georgia judge dismisses two criminal charges against Trump in Fani Willis' 2020 election interference case
McAfee dismissed six of the charges against Trump in March, saying Willis failed to provide sufficient detail.
McAfee last month also dismissed two other criminal charges against Trump, saying Willis and the Georgia state attorney lacked authority to bring charges related to allegations of filing false documents in federal court.
However, McAfee upheld the racketeering charges in the case brought against all defendants.
Willis said in his filing that the trial court “erred in striking out six of the indictments in this case.”
“The indictment enabled the cross-appellants to fully appreciate the conduct at issue and to prepare an intelligent defense to the charges,” Willis argued, adding that the indictment “provides a wealth of context and factual evidence. It contains the following assertions.''
Willis argues that the court “should vacate the trial court's order and reinstate counts 2, 5, 6, 28, 36, and 38 of the indictment.”
Steve Sadow, Trump's lead defense attorney in the case, told Fox News Digital that Willis' brief was “simply wrong as a matter of law.”
“The trial court's order to dismiss properly determined that the state did not adequately defend the dismissed cause of action allegations under Georgia law,” Sadow said.
The case was left in limbo after it was revealed that Willis had an “improper relationship” with Nathan Wade, the prosecutor he hired to build the case against Trump. Mr. Wade subsequently resigned.
