FBI Surveillance Watchdog Unit Shut Down
A report from the New York Times stated that FBI Director Kash Patel has disbanded the agency’s surveillance oversight unit.
An official familiar with the situation indicated that the internal audit department had been tasked with ensuring adherence to surveillance regulations, especially concerning the Foreign Intelligence Surveillance Act (FISA).
According to reports, Cindy Hall, the department’s Assistant Director, recently retired. While one source suggested that he was “forced” to retire, another insider claimed the FBI characterized the move to Congress as “voluntary.”
Before its closure, Hall was trying to expand the office’s operations, as noted by the New York Times.
The shutdown of the watchdog unit is part of a broader restructuring within the agency. Sources told the outlet that its functions, along with those of the Department of Integrity and Compliance, have been merged into the inspection department.
Agencies like the FBI argue that FISA is essential for addressing security threats, yet they’ve faced allegations of misusing FISA powers.
The agency relied on documents from Christopher Steele to secure a FISA warrant for surveillance on Carter Page, a former aide in Donald Trump’s 2016 campaign.
In a 2019 finding, the Department of Justice’s inspector general identified “significant inaccuracies” in the FBI’s FISA warrant application concerning Page.
While working on Capitol Hill, Patel was influential in examining the FBI’s FISA warrants and Steele documents.
Section 702 of FISA was reportedly utilized nearly 300,000 times from 2020 to early 2021. A document from 2023 showed the agency made 23,132 inquiries since January 6, 2021, with Section 702 being used for investigations related to Capitol disturbances and protests following George Floyd’s death.
Though designed for foreign surveillance, Section 702 has come under fire for enabling warrantless surveillance of U.S. citizens.
The Senate voted to renew FISA in April 2024.
The FBI was contacted for a response but had not replied at the time of publication. Interestingly, the number of queries the FBI has allegedly made about Americans has decreased sharply.
From December 2023 to November 2024, the agency logged 5,518 queries associated with Section 702 compared to about 57,094 the previous year.
Patel has condemned abuses tied to FISA and emphasized the need for greater transparency going forward.
In a recent interview on Fox Business, he expressed that the bureau “deliberately failed the American people” during the investigation known as Crossfire Hurricane.
In a tweet, he stated that earlier FBI leadership manipulated the FISA process during presidential elections, hiding the truth. Now, he claims, they are working to rectify these issues and provide clearer transparency for the public.
