The sentence of eight years, issued by Judge Deborah Boardman, is being criticized, particularly in light of Rosuke’s identification as transgender. This attack occurred in June 2022, just weeks before the Supreme Court announced the significant Dobbs decision.

The eight-year sentence is notably shorter than what the Department of Justice (DOJ) had recommended—30 years. For context, Rosuke’s defense team advocated for a lighter sentence of only eight years.

During the hearing, Boardman acknowledged that while Rosuke’s actions were indeed serious and could be condemned, she also considered mitigating factors. These included his voluntary confession and cooperation with law enforcement.

Some commentators have expressed outrage over the sentence. Mike Davis, a conservative lawyer, labeled Boardman’s ruling a “national dishonor,” emphasizing that it fell far short of the 30 years suggested by prosecutors. He remarked, “No mistake. Democrats today want to kill conservatives,” which reflects escalating tensions within political discourse.

Additionally, there were questions raised about Rosuke’s potential transfer to a women’s prison, which reportedly left some observers outraged. This added another layer of complexity to the ongoing discussion surrounding the case.

Boardman is also facing scrutiny for deciding on the lighter sentence for someone who posed a clear threat to a Supreme Court Justice. Many have called the ruling “pathetic,” with critiques that it seems disproportionately lenient compared to penalties for less severe crimes.

The DOJ is preparing to appeal Boardman’s ruling, which suggests that this case will continue to generate significant discussion and dissent. Attorney General Pam Bondy indicated this move shortly after the sentence was announced.
