On Thursday, Baltimore US District Judge Ellen Hollander was sidelined with a group of unions who filed a lawsuit alleging that Dozi’s actions violated privacy laws and put American data at risk.
Hollander questioned why Doge needs to “seemly free access” to Social Security data, and government lawyers argued that anonymizing data would slow the effort down significantly.
“For about 90 years, the SSA has been led by the fundamental principles of privacy expectations regarding its records. This case exposes a wide crack within the foundations,” Hollander wrote in the ruling.
By injunction, DOGE workers have ordered that non-anonymized data be deleted from Social Security records obtained after January 20th. The ruling has made it anonymous and allows workers to access data they received training and background checks.
Hollander had previously criticized Doge with a temporary injunction in the same incident in March.
“The Doge team is engaged in fishing expeditions in SSA, essentially seeking fraud epidemics based on more than doubt,” she previously wrote. “I’ve started searching for Haystack proverb needles, but I don’t have any specific knowledge that the needle is actually in the haystack.”
In a recent ruling, Hollander acknowledged that Doge Mission is a valuable pursuit.
“The purpose of dealing with fraud, waste, mismanagement and bloating is admirable and something that the Americans probably praise and support,” she writes. “It’s true that taxpayers have every right to expect the government to ensure that their hard-earned money is not wasted.”
The 75-year-old judge was appointed by former President Barack Obama.
