Federal Judge Stops Biden Agencies from Opening Obamacare to Illegals

A federal judge has halted President Joe Biden's plan to extend the Affordable Care Act, known as Obamacare, to illegal aliens enrolled in the Deferred Action for Childhood Arrivals (DACA) program.

In May, Biden and Vice President Kamala Harris announced a final rule opening Obamacare enrollment to some DACA illegal aliens enrolled in the program. Former President Barack Obama first created the DACA program by executive order, and over the years it has protected more than 1 million illegal aliens from deportation.

On Monday, District Judge Daniel Trainor granted a preliminary restraining order and injunction to prevent Biden's agency from implementing such a plan while the matter is heard in federal court.

“This decision is a huge victory for the rule of law,” said Kansas Attorney General Kris Kobach (R), who led the lawsuit. said In a statement:

Congress never intended for illegal aliens to receive Obamacare benefits. In fact, two laws prohibit such benefits. The Biden administration attempted to break these laws. But we fought back and defeated the Biden Justice Department. [Emphasis added]

Alabama, Arkansas, Idaho, Indiana, Iowa, Florida, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, Virginia joins Kansas in a lawsuit against the Biden-Harris administration. .

The preliminary injunction is especially important because President-elect Donald Trump is expected to rescind the final rule after he takes office next January.

Previous cost estimates suggest that enrolling about 100,000 DACA illegal aliens in Obamacare would cost U.S. taxpayers about $300 million a year. Some estimates put the annual financial burden at about $2.8 billion.

In his 2012 State of the Union address, Obama vowed to Americans that illegal aliens would not be covered by Obamacare, to which Rep. Joe Wilson (R-South Carolina) responded, “You're a liar!” he yelled.
