Florida Takes Legal Action Against Adult Gaming Platform and Payment Processor for Failing to Verify Age

Florida Sues Nutaku and SegPay Over Age Verification Violations

Florida has initiated legal action against the adult gaming platform Nutaku and payment processor SegPay, alleging violations of the state’s age verification laws.

Attorney General James Usmierer has stated that his office is suing Iro, which operates Nutaku, for neglecting to follow the state’s age verification law (HB3) implemented in January. This law mandates that websites ensure visitors from Florida are at least 18 years old.

Nutaku, owned by Aylo—also the parent company of major adult sites like Pornhub—operates two main sites: the family-friendly Nutaku.com and the adult-oriented Nutaku.net. The lawsuit also references SpiceVids, an adult video curation site under Iro’s ownership. When the Age Verification Act took effect, Iro restricted access to some adult sites in Florida, but SpiceVids and Nutaku remained accessible, requiring only a checkbox to confirm visitors are over 18 without further identity checks.

In another part of the complaint, Usmierer highlights that Lustyheros, an adult gaming site, does not have age verification in place for Florida users, suggesting that SegPay, known for processing payments in the adult industry, should be held accountable for its services to the site. Notably, SegPay maintains a business address in Florida.

An Iro spokesperson contends that both SpiceVids and Nutaku are adhering to the age verification laws and plans to “vigorously defend these claims in court.”

The spokesperson further asserted that since the rollout of SpiceVids, age verification measures have been put in place compliant with legal standards, claiming that adult games only account for a defined percentage of content on those sites.

Both complaints assert that “access to online pornography is a serious threat to the health and well-being of minors.”

This is not Florida’s first legal effort against adult websites for age verification noncompliance. Recently, the state also filed lawsuits against prominent porn sites within the Iro umbrella, such as Xvideos and Bang Bros, citing similar violations.

As of January 1, 2025, Florida joins 19 other states in requiring age checks on adult websites. Currently, 29 states have enacted similar laws or are in the process of doing so, although eight states have not passed related bills. Advocates for these regulations argue that they are essential in shielding children from potentially harmful adult materials online.

Other adult sites, including Pornhub, have adopted different strategies, sometimes removing state services to mitigate access to underage visitors.

Usmierer, reflecting on his responsibilities as a father, stated, “It’s completely unacceptable for any porn company to disregard Florida’s age verification laws and expose minors to harmful content.”
