The top House Democrat believes Supreme Court Justice Samuel Alito is a “sympathizer of insurrectionists” because the flag was flown in front of his property in 2021.
“Justice Alito is a sympathizer of the insurrectionists, and he appears to be joined by his right-wing ally Clarence Thomas,” House Minority Leader Hakeem Jeffries said at a press conference Friday.
Alito and his wife, Martha Ann, have come under fire for previously flying the “Appeal to Heaven” flag, a white flag with a pine tree on it. The flag was commonly used in the Revolutionary War but has more recently become associated with extremism after being flown by rioters who stormed the Capitol on January 6, 2021.
Asked about his criticism of Justices Alito and Clarence Thomas, Jeffries told Fox News’ Chad Pergram that “the American people are pretty much unanimous that the right-wing justices on the Supreme Court are completely out of control.”
Jeffries also argued that the Supreme Court cannot police itself when it comes to ethics. “Since President Trump nominated the three justices, the Supreme Court has handed down a series of “highly partisan, right-wing and extreme decisions.”
