FTC Taking Action Against Misleading 'Made in USA' Product Claims

Chairman of the Federal Trade Commission, Andrew Ferguson, is spearheading a rigorous initiative to target businesses that falsely claim their products are “Made in America,” implementing notably aggressive measures to safeguard consumers.

During an interview on Breitbart News Saturday with host Matthew Boyle, Ferguson discussed how these efforts resonate with the priorities established during the Trump administration.

Ferguson stated, “As you know, President Trump has directed the federal government to ensure that companies claiming their products are made in the U.S. genuinely do so. This is crucial, as there’s ample evidence that many Americans are willing to pay more for American-made goods for valid reasons.”

According to Ferguson, who also holds the position of vice chairman on the Office of the President’s Special Committee to Eliminate Misconduct, American-made goods tend to be more trustworthy because they come from “friends, family, neighbors, and your fellow countrymen.”

He added, “Our goal isn’t just a thriving consumer economy; we want manufacturing to flourish as well. If we want to capitalize on the consumer preference for American-made products, we need to ensure honesty in that representation.”

FTC regulations dictate that products marketed as “Made in the USA” must be mostly manufactured within the United States, yet not all businesses adhere to this guideline.

Ferguson relayed that “over the past year, the FTC has taken notable and assertive actions to enforce these standards.” He noted that the commission had sent warning letters to numerous companies in 2025 before launching several civil actions in federal court about five months ago.

Millions have been recovered from various companies, with Ferguson indicating that the funds will be returned to consumers who unknowingly purchased products misrepresented as American-made.

One particularly ironic case highlighted by Trump’s FTC involves Americana Liberty LLC and Three Nations LLC. These companies allegedly sold items adorned with the patriotic U.S. flag and labels claiming they were “Made in the USA,” “All-American,” and more, despite some being entirely imported from China or containing significant foreign components.

Ferguson explained to Boyle, “The investigation revealed that some products were falsely labeled as American-made while actually being made in China.”

He concluded, “Thus, we initiated enforcement action. They consented to a decree prohibiting future occurrences and faced penalties.”

The FTC reported that the defendants accepted a proposed resolution that would result in $167,743 allocated for “consumer relief” and would prevent any misleading claims regarding the origin of their products.
