Illinois Democrats Push Back on Immigration Policies
Illinois Democrats are defending the state’s immigration policies against criticisms from the Trump administration, emphasizing their commitment to uphold constitutional rights, ensure public safety, and support local cooperation with federal authorities.
In a recent letter, Senators Jesus Garcia and Richard Durbin noted that the Department of Justice has designated both Illinois and Chicago as “sanctuary jurisdictions,” and they disputed the idea that either has violated any laws. The letter was backed by several Illinois Democrats who highlighted the state’s trust laws, initially signed by former Governor Bruce Rauner, which critics have labeled as sanctuary-style policies. These laws prevent detaining individuals solely based on their immigration status.
The senators pointed out that Chicago’s Welcome City ordinances restrict arrests or detentions related to civil immigration violations. They also prevent local officials from allowing ICE access to detainees unless it’s for legitimate law enforcement reasons, not just immigration enforcement.
They referenced legal precedents, arguing that holding individuals without proper documentation may violate the Fourth Amendment, while acknowledging that federal detention does not.
Garcia, who immigrated from Durango, Mexico, in 1965, expressed concerns that federal agencies should not feel “robbed” of their authority. He emphasized a dedication to rule of law, public safety, and the U.S. Constitution.
In reiterating support for local laws, Garcia and Durbin indicated that these measures do not hinder federal immigration enforcement. The Justice Department acknowledged receipt of their letter but did not provide additional comments, and inquiries to DHS went unanswered.
