Garth Brooks’ judge pauses his attempt to have sexual assault lawsuit dismissed: docs

A judge has denied Garth Brooks' request to have his former makeup artist's sexual assault lawsuit dismissed, according to documents obtained by FOX News Digital.

U.S. District Judge Michael Fitzgerald denied Mr. Brooks' motion to dismiss the complaint, filed in the Central District of California, because the “plaintiff” is pending in another state. A court date originally scheduled for Monday, Dec. 16, was vacated by the judge's Dec. 11 ruling.

Brooks, 62, originally filed the lawsuit in Mississippi in September in an attempt to block an impending Jane Roe lawsuit, according to a complaint obtained by Fox News Digital. In a document filed under the name “John Doe,” Brooks denied the woman's claims that he raped her in 2019.

The judge ruled that the California case will be “stayed” pending further information about the Mississippi case, which is expected to be announced within 10 days of the order. The “Friends in Low Places” singer requested that the California lawsuit be moved to Mississippi, where the makeup artist lives.

“The court finds that the most appropriate course of action is to allow the courts of Mississippi to decide Plaintiff's fair claims in the first instance,” the document states.

Representatives for Brooks did not immediately respond to Fox News Digital's request for comment.

In a complaint filed by a former makeup artist, she accuses Brooks of assault and battery. She accused Brooks of openly talking about sex in front of her, exposing his genitals, sharing sexual fantasies with her, texting her explicit messages and physically groping her breasts.

According to the complaint, she alleged that Brooks raped her in 2019 during a business trip to Los Angeles for the Grammy Awards tribute to R&B singer Sam Moore.

“Jane Roe” claimed that only one room was booked for the two to share, not separate rooms.
