A Miami, Florida-based nursery school has been accused of discriminating eligible Americans in blue-collar agricultural jobs in Georgia and importing foreign H-2A visa workers instead.

The H-2A visa program allows U.S. agricultural companies to outsource an unlimited number of U.S. jobs to foreign workers each year. Foreign workers can extend their stay for up to three years. Foreign family members of H-2A workers can also come to the United States on H-4 visas.

In 1997, over 16,000 foreign visa workers were imported to the United States for agricultural jobs. By 2021, that number had ballooned to a record 258,000 foreign visa workers, and the H-2A visa program had increased him more than 1,500% in less than 25 years.
