Giuliani calls on Fulton County judge to schedule hearing on motion to quash Georgia indictment

Rudy Giuliani asked a Georgia judge Thursday to schedule a hearing on a motion to dismiss criminal charges against him on election interference charges.

The request comes nearly four months after the initial complaint was filed on Sept. 8.

Giuliani has pleaded not guilty to a series of charges related to Georgia's sweeping election interference scandal, in which 19 people, including former President Trump, were indicted. Prosecutors alleged that Mr. Giuliani deliberately lied in an attempt to sway Georgia's electors to overturn the 2020 election results.

Lawyers for the former New York mayor argued in a September motion for removal that the original indictment was “flawed.”

“Because the defendant is incomplete in form and substance and has not provided sufficient notice of what he will have to defend against at trial, the defendant has no right to dismiss the charges against him. “This court is moved and the arguments in the said indictment are insufficient to protect him from double charges and there is a risk of further prosecution,” his lawyers wrote.

The motion describes the 98-page indictment against Mr. Giuliani and other defendants as “a conspiratorial bouillabaisse of purported criminal acts, everyday activities, and constitutionally protected speech.”

Four of the 19 defendants, including three of Trump's lawyers, admitted to committing crimes to avoid trial. A trial date has not yet been set for the case, but prosecutors have requested that the trial begin in August.
