Rep. Claudia Tenney of New York filed a lawsuit against President Biden under the 25th Amendment after the special counsel cleared him of wrongdoing but painted him as an old man with a failing memory. He called on Biden administration officials to “consider” removing the president from office.
in Letter obtained by Fox News DigitalMs. Tenney reportedly sent a letter to Attorney General Merrick Garland on Thursday night sharing her “grave concerns.”
“After concluding that President Biden intentionally and intentionally repeatedly deleted, mishandled, and disclosed classified documents over a period of decades, we still recommended that Mr. Heo not be charged,” she said. It is stated in the letter. “The special counsel’s reasoning was alarming.”
Special Counsel Robert Hur on Thursday announced the findings of a case involving Biden’s handling of classified materials. Ho’s 388-page report examined how documents from Biden’s time as vice president were leaked to his home and old office space in Wilmington, Delaware. Mr. Xu described Mr. Biden as an “elderly man with a poor memory” and determined that he “intentionally” retained the documents but that he did not press charges.
Tenney argued that the Justice Department “ethically” cannot bring charges against former President Trump and will decline to bring charges against Biden.
She argued that Biden, 81, lacks the ability to carry out his responsibilities as president.
“Therefore, it is your duty to consider the procedures for removing a president from office under the 25th Amendment,” she wrote. “President Biden needs to be indicted or he needs to be removed from office.”
The 25th Amendment, ratified after the assassination of former President John F. Kennedy, is the procedure for replacing the president in the event of his death, removal, resignation, or incapacity.

“I got this country back on its feet,” Biden angrily defended himself at a press conference Thursday night following the special counsel’s report.
