Legal Analyst Discusses Charges Against New Jersey Lawmaker
Gregg Jarrett, a legal analyst, noted on Tuesday that Democrat Lamonica McIver from New Jersey might face conviction for assault based on bodycam video evidence.
Alina Haba, the acting U.S. Attorney for New Jersey, brought forth accusations against McIver regarding an incident on May 9th involving lawmakers at Fracus close to an ice facility in Newark. Jarrett pointed out that a physical attack isn’t necessary for a guilty finding; merely interfering with an officer could suffice.
Lawrence Jones, co-host of “Fox and Friends,” expressed a desire to separate McIver’s role as a lawmaker from the accusations, stating it’s more about the specific actions reported. He highlighted behaviors like resisting, blocking, or threatening officers.
Jarrett mentioned that the bodycam footage shows actions that could legally be considered an attack. He emphasized that even words can hold weight, noting that her remarks are as significant as any physical actions. Nevertheless, he asserted that she is presumed innocent until proven guilty.
Jarrett also referenced policies put forth by President Donald Trump while in office, which addressed illegal immigration and labeled certain organizations as foreign terrorist groups. He suggested that McIver’s defense of monitoring the situation wouldn’t stand robustly under scrutiny.
“If her justification is that she was exercising legislative oversight, that’s not sufficient. Being a Congress member doesn’t grant immunity from criminal behavior,” he stated, adding that orderly procedures exist for lawmakers to inspect detention facilities.
Jarrett remarked that instead of following protocol, Homeland Security intervened when a confrontation arose as Democrats allegedly attempted to bypass security.
