Halle Berry's former partner receives temporary restraining order, alleges she mistreated their son

Halle Berry’s Attorney Responds to Abuse Claims by Olivier Martinez

Halle Berry’s lawyer rebuffed allegations made by her ex-husband, Olivier Martinez, asserting that claims of child abuse are “meritless.” This statement came after Martinez was granted a temporary restraining order against Berry on Thursday.

Martinez is reportedly pursuing sole custody of their 12-year-old son, Maceo, claiming Berry has subjected him to both physical and emotional abuse. These allegations were detailed in legal documents reviewed by various sources.

Martinez described incidents where Berry allegedly harmed their son, saying she caused him “emotional and mental distress” and went so far as to physically assault him. He specifically mentioned an episode where she purportedly choked Maceo, asserting that this is not an isolated incident, but part of a longer pattern of mistreatment.

In response, Berry’s attorney, Marina Beck, characterized Martinez’s filing as exaggerated and misleading. She cited existing evidence and court rulings that suggest Martinez has repeatedly violated court orders and disrupted necessary therapeutic interventions for Maceo. Beck also noted that Berry is accustomed to such conduct from Martinez, expressing her resolve to continue fighting for their son’s best interests.

As part of the temporary restraining order, Berry must maintain a distance of 100 yards from Martinez and is allowed to spend time with Maceo only during court-mandated visitations twice a week and every other weekend, pending a hearing on October 16.

The couple has been mandated to participate in confidential mediation regarding custody arrangements. According to Martinez, a recent incident involved Berry entering their son’s room and making derogatory comments about him, followed by an alleged physical confrontation where she choked him while shouting about dominance.

Martinez has indicated that Maceo contacted him after the incident, claiming he had been attacked by Berry, who also had her fiancé present at the time. Furthermore, the petition insists that Berry should remain sober during their visits with their son and undergo sobriety tests.

Berry’s obligations under their divorce agreement include paying substantial monthly child support, along with covering private school tuition, extracurricular activities, and healthcare costs for Maceo. Their divorce, finalized in 2023, occurred eight years after they initially separated.

In the court judgment, both parents must ensure a positive environment around Maceo, avoiding negative remarks about one another in his presence. The current custody agreement allows Maceo to spend time with both parents during the week and alternating weekends, with some limitations on phone calls.

This new restraining order request mirrors Berry’s earlier filings for sole custody, which cited Martinez’s disruptive behavior impacting their son’s well-being. Berry is also a mother to 18-year-old Nahla, whom she shares with ex-boyfriend Gabriel Aubry.
