The temporary restraining order issued by Olivier Martinez against Halle Berry has been extended through the weekend, as their intense custody battle is set to continue into next week.
Both the “Monster’s Ball” actress and the French actor returned to the Stanley Mosk Courthouse in Los Angeles for a hearing that marks the fifth day of their proceedings. This session focused on claims that Berry allegedly abused their 13-year-old son, Maceo.
Martinez, 60, resumed his closed-door testimony from Thursday, reinforcing his allegations against Berry. This came despite the fact that he had previously declared in a 2024 sworn statement that there was no history of domestic violence between the two.
After a break for lunch, Berry’s fiancé, Van Hunt, 56, took the stand, and his testimony was also conducted behind closed doors.
As Hunt exited the courtroom around 4 p.m., he appeared relieved but was later spotted laughing with a member of Berry’s legal team.
After the court session ended at 4:30 p.m., Martinez and his legal team left together, followed by Berry and her representatives. Berry, 60, was seen affectionately rubbing Hunt’s arm in the hallway as they departed. Her daughter, Nahla Aubry, 18, is anticipated to testify virtually when the hearing reconvenes on Monday.
On Thursday, during cross-examination conducted by Berry’s attorney, Marina Beck, Martinez was questioned about allegations of Berry’s abuse during their relationship, which included incidents from as far back as ten years ago. Beck presented Martinez with a declaration he signed two years prior, affirming there had been no domestic violence between them.
Martinez confirmed the signature, and when asked if the statement was true at the time of signing, he acknowledged that it was. His lawyer later explained that this declaration pertained to a financial matter rather than the custody case.
Earlier that Thursday, Berry testified concerning their son, Maceo, who had already spent several hours on the witness stand during the trial. The court proceedings are linked to Martinez’s claims that Berry choked their teenage son during a confrontation at her house on September 26.
Martinez contends that this incident is reflective of a pattern of abusive behavior, claiming that Maceo contacted him after the incident to be picked up. A judge has already granted Martinez a temporary domestic violence restraining order and his request for primary custody of Maceo, limiting Berry’s access to him during the ongoing dispute.
Beck has previously described Martinez’s accusations as “entirely meritless and deliberately misleading,” asserting that Berry categorically denies any wrongdoing. Nahla Aubry has also provided a court declaration stating that she has never witnessed her mother abuse Maceo.
Berry’s attorneys have claimed that Martinez has interfered with Maceo’s education and therapy. They accuse him of involving their son unnecessarily in their disputes. Berry is seeking sole legal custody to more effectively manage Maceo’s education, therapy, and medical care, as well as asking for the dismissal of the restraining order and reinstatement of the original 50/50 physical custody arrangement.
Martinez and Berry married in a private ceremony in 2013 and welcomed Maceo later that year, with the couple separating in 2015. They seemed to have resolved their divorce issues in 2023 after a protracted legal battle, wherein Berry was ordered to pay her ex-husband $8,000 monthly for child support.
