According to the department, authorities responded to a call about a shooting at a residence in the 1100 block of Beale Street in South Bend on Dec. 14 around 9:20 p.m.
Arriving officers found a man, now identified as 68-year-old Richard Davis, suffering from gunshot wounds, WNDU said, adding that he later died at the hospital.
A subsequent investigation based on statements from witnesses, including neighbors, revealed that the homeowner and his wife were preparing to enter the home when the alarm from the security system went off, police said. That's what it means.
The homeowner asked his wife to remain in the car while she approached the back gate of the property, WNDU reported, citing court documents.
At that point, Davis approached the homeowner while holding a chainsaw over his shoulder, the station said.
The homeowner said he feared he would die or be seriously injured when Davis approached him, WNDU reported.
The homeowner told police he fired a handgun once, hitting Davis and then told his wife to call 911, police said.
Davis reportedly took a chainsaw from the homeowner's garage before the shooting, WNDU said, adding it was unclear if the chainsaw was working at the time.
The St. Joseph County Prosecutor's Office said it will not file criminal charges in connection with the shooting because it cannot prove it was not a justified homicide.
