The House Judiciary Committee has recommended that former President Joe Biden’s ghostwriter be charged with contempt of Congress after federal investigators found that the president gave the ghostwriter access to classified materials.

The Republican-led committee on Tuesday accused Mark Zwonitzer of failing to comply with a congressional subpoena in March seeking records, documents and materials related to the writing of Biden’s 2017 memoir, “Promise Me, Dad,” and the president’s 2021 book, “Promises to Keep.”

“Mr. Zwonitzer continues to fail to produce all documents and materials in response to the Committee’s subpoena,” the report said. “The materials requested from Mr. Zwonitzer are critical to the Committee’s understanding of the manner and extent of President Biden’s improper handling and unlawful disclosure of classified materials, and Mr. Zwonitzer’s use, storage, and deletion of classified materials on his computer.”

The committee argues that Zwoniter’s failure to comply with the subpoena “impeded the Committee’s ability to properly oversight the Special Counsel.” [Robert] the outcome of the Hoare investigation, the Department of Justice’s commitment to a fair trial, and the preservation and disclosure of classified presidential materials.”

Zwonitzer, 61, recorded several interviews with Biden in 2017 and Biden read “nearly verbatim” from his notebooks containing highly classified information on foreign policy and national security, according to Harr’s report on his investigation of Biden’s classified documents.

As a civilian, Zvonitser was not allowed access to the classified documents, creating obvious legal problems for the 81-year-old president.

Heo was appointed by Attorney General Merrick Garland in January 2023 to investigate Biden’s possible mishandling of classified materials, but the ghostwriter allegedly erased the recordings.

“The recordings have significant evidentiary value,” Heo wrote in his 388-page report, adding that he “considered whether to sue the ghostwriter for obstruction of justice but decided not to.”

In one recording, Biden can be heard telling Zwonitzer, “I found all the classified documents downstairs,” referring to the home Biden rented in Virginia after leaving office.

Meanwhile, House Judiciary Committee Chairman Jim Jordan (R-Ohio) has demanded the production of transcripts, audio and video recordings of Zwonitzer’s interview with Biden.

According to the report, Złonitzer’s lawyers said the subpoena was “broad” and that “the materials are not clear on how [sought] Promote the purpose of [the Committee’s] They argued that it was a “legislative reform” that “violated Złonitser’s First and Fifth Amendment rights.”

“Finally, Zwonitzer argued that there was no need to produce the subpoenaed documents and materials because they ‘contain highly personal information about the President,'” the report said.

The committee is scheduled to consider the contempt resolution on Thursday, after which there will be a vote on whether to send the resolution to the full House for consideration.
