House Democrat tries to corner the wrong person to help Biden — but it’s a former judge with all the right answers

Rep. Dan Goldman (D.N.Y.) learned Thursday that he needs to be better prepared the next time he wants to question a former judge.

At the House Oversight Subcommittee Under hearing “Catch-and-release results at the border,” Goldman challenged Matt O’Brien. Former Virginia Immigration Judge, about his assertion that President Joe Biden has the authority to close the border. Democrats are trying to protect Biden by saying this is not true.

“On what authority is it mentioned?” Goldman challenged.

“As stated earlier, Section 1182(f) of the Immigration and Nationality Act is the statutory provision at issue. trump vs hawaii‘ replied Mr O’Brien. “This is a provision that allows the president, by proclamation, to temporarily suspend the entry of certain types of aliens into the United States.”

In fact, Section 1182(f) of the Immigration and Nationality Act it is clear:

If the President determines that the admission of any alien or alien of any kind into the United States is detrimental to the interests of the United States, the President may, by proclamation, suspend the admission of such alien for such period as he deems necessary. can do. Recognize all aliens or any class of aliens as immigrants or nonimmigrants, or impose such restrictions on the entry of aliens as it considers appropriate.

Goldman did not get into the nature of O’Brien’s response and then targeted Donald Trump.

“So why didn’t Donald Trump use it?” Goldman asked.

“He did it—so.” trump vs hawaii This case went all the way to the Supreme Court,” O’Brien explained.

In fact, the Supreme Court A ruling was made in favor of Trump in 2018..court agreed Section 1182(f) “gives the President broad discretion to suspend the admission of aliens to the United States.”

In a follow-up question, Mr. Goldman asked why President Trump relied on Title 42 for mass deportations. O’Brien said Title 42 is intended for “public health crises,” while 1182(f) is “general authority to control borders in the face of crisis.” He explained that this happened during the coronavirus pandemic.

Understandably, Mr. Goldman chose not to ask Mr. O’Brien any further questions.
