A Virginia High School runner caught on video hitting his opponent with a baton during last week's State Championship relay event, was charged with assault and battery.
Bethany Harrison, federal lawyer for the city of Lynchburg on Wednesday. He told ABC News In connection with the incident, a misdemeanor charge of assault and battery was issued against Alaila Everett, a senior at IC Norcom High School in Portsmouth.
“We are summarised in ensuring that the criminal justice system, which we believe is not guaranteed in this situation, is carried out fairly and based on a legitimate process.”

Karen Tucker, a junior at Everett and Brookville High School, was the second leg in the 4x200m relay at the Virginia State High School League Championship at Liberty University in Lynchburg on March 4th.
During the race, Tucker passed Everett. WSET-TV Tucker felt a blow in the back of his head, and the hit knocked Tucker onto the surface of the track and out of the race.
The judge has disqualified the IC Norcom Relay team for “contact interference,” the station said, adding that doctors are treating Tucker for a concussion and a fracture of a skull.

Everett and her parents told ABC News their videos show that Tucker was getting too close to Everett as he tried to move forward, and then Everett lost the balance that led to a random baton strike.
Everett emphasized, “I know my intentions, so I'll never intentionally hit anyone.”
After the incident, the athletic director of IC Norcom High School and Everett's father apologised to the Tucker's family over the phone, citing Tucker's parents, ABC News said.
Everett told Wavy that people “came a ghetto, a racist slander, a death threat.” This is all for a 9-second video.”
So, the Portsmouth NAACP told ABC News it is reviewing the incident, along with slur and threats that Everett said he was receiving.
“We are collectively committed to ensuring that the criminal justice system, which we believe is not guaranteed in this situation, is fair and based on a legitimate process,” the organization said in a statement Wednesday, adding that ABC News is seeking Everett to be “annual of criminal proceedings.”
Before the charges filed against Everett, Wavy said her family had court documents attached and Tucker wanted a protective order.
