ICE officials confirmed to FOX10 News that Rodas first crossed the U.S.-Mexico border in December 2018 near Hidalgo, Texas. Rather than remain in custody or be removed, Rodas was given a Notice to Appear in Immigration Court (NTA) at a later date. He was then released into the interior of the United States, where he was resettled in Mobile County.

In 2021, Rodas was arrested and charged with DUI in Mobile County. In this incident, Rodas crashed his car into a utility pole while driving drunk.

ICE officials were aware of Rodas’ arrest but did not take him into custody due to President Joe Biden’s administration’s policy that DUI arrests are not considered grounds for deportation.

“Most people would consider this type of DUI a serious threat to public safety, but under Biden and Mayorkas’ priorities, he should not have been someone that ICE would be allowed to go after at that point,” Jessica Vaughn, policy director at the Center for Immigration Studies, told Fox 10 News.

In 2022, Rodas pleaded guilty to a DUI charge and was sentenced to 180 days in jail and court-ordered supervision after being released on probation. After completing his sentence, Mr. Rodas eventually stopped following court-ordered supervision guidelines and failed to comply with the conditions of his release.

Mobile County District Attorney Keith Blackwood told FOX10 News that his office has asked Rodas to revoke Rodas’ probation because the agency responsible for his probation failed to comply with his probation. He said he had never had one.

Lawyers for Rooker’s family said the federal government should have deported Rodas long before his loved one died.

“If that were the case, none of this would have happened,” their attorney said. “The federal government has access to all the information about arrests and things like that.”

In a separate lawsuit in Maryland, the Angell family of 20-year-old Kayla Hamilton is accused of brutally murdering and raping a young woman. He is suing the federal government for $100 million for his release.
