Jack Smith Abused Power, Interfering in Election

The newspaper's editorial says that Special Counsel Jack Smith has abused his power to interfere in the 2024 election with a massive 165-page memorandum accusing President Trump of criminal conduct. new york times Wednesday.

As Breitbart News reported, Mr. Smith wrote a memo four times the length normally allowed for legal briefs, enough to meet the Justice Department's 60-day deadline leading up to Election Day, to Tanya's office in Washington, D.C. Submitted to Judge Chutkan.

Jack Goldsmith, a professor at Harvard Law School and a former senior George W. Bush official who has criticized Mr. Trump, wrote: times It appears Mr Smith violated legal norms and attempted to improperly influence voters.

Mr Goldsmith also suggested that Mr Goldsmith owed the public an explanation. he I wrote:

This is not the first time Mr Smith has flouted departmental rules, increasing the need for an explanation. In December 2023 and February 2024, they asked the Supreme Court to expeditiously consider Trump's immunity request, citing the “urgent public importance” of bringing him to justice as soon as possible. . Mr. Smith never explained the need for speed.

Many plausibly concluded that he wanted his trial evidence to be publicly available so voters could make an informed decision. This motive would violate a Justice Department rule that prosecutors “must never choose the timing of any action” to “advantage or disadvantage a candidate or political party.” Mr Smith gave the strong impression of dishonesty, at least without any explanation, in a situation where public confidence in the integrity of his decisions was vital.

Some may blame the Supreme Court for Smith's predicament. The court refused to comply with Mr. Smith's request for an expedition. And that immunity ruling would make a pre-election trial impossible, requiring a complex analysis by Judge Chutkan to decide what charges to pursue against Trump. These considerations are independent of Mr. Smith's obligation, once under former Attorney General Eric Holder, to comply with (and appear to comply with) the relevant regulations. explainedwhich aims to “maintain public confidence in the Department's ability to carry out its duties free of political influence.”

Goldsmith also questioned whether President Joe Biden and Vice President Harris may have broken norms regarding judicial process by commenting on the case and, in Harris' case in particular, attempting to exploit the case for political purposes. suggested.
