Olathe, Kansas (W.D.A.F.) — A Kansas judge has approved a motion by prosecutors to dismiss several people. Accusations against Jackson Mahomesthe brother of Kansas City Chiefs quarterback Patrick Mahomes, but the 23-year-old could still head to trial.
on tuesday, The prosecutor filed a motion Three felony counts of aggravated sexual assault against Jackson Mahomes have been dismissed in Johnson County. However, he still has one misdemeanor charge remaining that could go to trial.
The younger Mahomes appeared in Johnson County Court on Wednesday for a preliminary hearing, where a judge ruled in favor of the motion.
The court document says: Victim at the center of the incident If she was forced to testify, she intended to assert her Fifth Amendment right against self-incrimination. Prosecutors said the woman would argue that even if she were granted immunity, she was not telling the truth to police and that her contact with Mahomes was consensual.
But at Wednesday's hearing, prosecutors argued that just because a witness doesn't testify doesn't mean the incident didn't happen.
On Tuesday, Mahomes' attorney Brandon Davis released the following statement to Nexstar's WDAF:
“As we have said from the beginning, Jackson did nothing wrong. We were completely confident that the truth of this matter would eventually come out. The defense remained… We reserve further comment until the charges are resolved.”
The charges stem from an incident that allegedly occurred on February 25, 2023. Aspen's Restaurant and Lounge in Overland Park.
The restaurant owner told police that Jackson Mahomes shoved one of his employees. She initially told investigators that she took him to another room. Surveillance video from inside the room showed Mahomes grabbing his owner by the neck and trying to kiss him, according to court records.
Mahomes pleaded not guilty to the charges last year.
Now that those three felonies have been expunged, Mahomes only has one remaining misdemeanor battery charge.
The misdemeanor victim is not the same as the victim involved in the three felonies, according to court records. Therefore, prosecutors still plan to pursue the charges.
In court Wednesday, Jackson Mahomes' attorney said he would not seek a diversion on the misdemeanor charge. Instead, they are calling for the case to go to trial.
Mahomes' case is scheduled for a pretrial hearing on March 22nd, with a two-day trial scheduled to begin on March 25th.
