A judge dropped charges in the D.C. case against President-elect Donald Trump following a request Monday from Special Counsel Jack Smith..
The decision relates to the investigation into the January 6 breach of the U.S. Capitol. Fox News Digital learned of Smith's request in advance early Monday.
“The government moved without prejudice to dismiss the superseding indictment,” U.S. District Judge Tanya Chutkan said in her ruling. “The defendant does not oppose the motion…and the court will grant it.”
Mr. Smith also filed a motion to dismiss the classified records lawsuit against Mr. Trump, which was dismissed by federal Judge Eileen Cannon in July. Cannon ruled that Smith was illegally appointed special prosecutor.

The move comes after Smith signaled earlier this month that he would begin winding down the case against Trump following Trump's victory in the 2024 presidential election. The application was published in a Department of Justice docket Monday afternoon.
Mr. Smith has already filed a motion to override all deadlines in the 2020 election interference lawsuit against Mr. Trump in Washington, D.C., a widely expected move to drop the case against Mr. Trump altogether. It didn't reach that point. Smith said his team plans to provide an update on the official status of the case against Trump on Dec. 2.
Mr. Trump has pleaded not guilty to all charges in the case and has issued the following defense: United States Supreme Court, The argument is based on presidential privilege.
The high court ruled that Trump is immune from prosecution for official presidential acts, forcing Smith to file new charges. Mr. Trump has also pleaded not guilty to these new charges. Trump's lawyers are seeking to have election interference charges against Smith dismissed in Washington, D.C., saying he was illegally appointed.

Trump posted on his Truth social account Monday afternoon that the lawsuit against him is “vacuous and lawless and should never have been filed.”
“These lawsuits, like all the others I've been forced to take, are empty and lawless and should never have been filed. Over $100 million in battles with Democrats and political opponents. Taxpayers were wasted. It was me,” Trump posted. “Nothing like this has ever happened in our country.”
