Jimmy Buffett’s Legal Battle Over Trust

Following the passing of musician Jimmy Buffett, his widow, Jane Buffett, has filed a legal petition challenging the management of the joint trust that oversees his considerable real estate assets. The couple, married since 1977, created this trust under the belief that it would serve her best interests.

In documents submitted to the Los Angeles Superior Court, Jane claims that Richard Mozenter, the co-manager of the trust, has not acted in a trustworthy or transparent manner. She described his behavior as “openly hostile,” arguing that he failed to provide essential information about the trust’s assets and finances.

According to Jane, despite her requests for clarity regarding her financial situation, Mozenter repeatedly evaded these inquiries over a span of 16 months. Frustratingly, this lack of communication left her in the dark about the state of her late husband’s assets, which she estimates to be worth around $275 million.

Interestingly, Mozenter has also sought to remove Jane as a representative of the trust, filing his own petition in Florida aimed at that goal. Jane contends that the management of the trust has become very problematic, asserting that she feels neither informed nor secure under Mozenter’s oversight.

After Buffett’s death, Jane stated she reached out to Mozenter to get a sense of what the expected financial distributions would be from the trust. Instead of assisting her, he allegedly offered excuses. In a recent estimate, Mozenter indicated she could expect net returns of less than $2 million annually, a figure that Jane believes is unacceptably low, especially considering the trust’s assets.

Furthermore, she argues that Mozenter acknowledged that Margaritaville, which is part of the trust, had distributed around $14 million in payments but hesitated to provide estimates of future distributions affecting her potential access to funds.

Jane’s legal filing calls into question Mozenter’s capability to manage the trust effectively, stating that if the returns are as low as presented, it reflects either negligence or a lack of genuine concern for her wellbeing.

Buffett, who passed away in 2023, built a considerable empire that included resorts and restaurants connected to his iconic brand. Despite Jane’s concerns about the trust, Mozenter suggested she might need to consider selling property or making adjustments to support her expenses.

It’s certainly a complex situation, and it appears there are significant disagreements about how the trust should be managed and what Jane is entitled to in terms of financial support going forward.

In their marriage, the couple welcomed three children—Savannah, Delaney, and Cameron—who are now navigating the aftermath of their father’s passing and the resulting legal turmoil.
