Evidence Against Capitol Riot Suspect Increases
On Monday, Jonathan Turley, a law professor at George Washington University, commented on the mounting evidence against Brian Cole, the individual accused of placing a pipe bomb just before the January 6, 2021, Capitol riot. He noted that any hopes for an insanity defense seemed to be fading.
The Department of Justice revealed Cole’s arrest on December 4, announcing charges for transporting explosives across state lines. Turley compared Cole’s situation to that of Tyler Robinson, who has been accused of attempting to kill conservative commentator Charlie Kirk. He suggested that neither suspect faces a favorable outcome in court.
“I think the evidence really doesn’t work in his favor,” Turley remarked during an interview. “Robinson’s attorney mentioned that there are incriminating statements made after the arrest. He seems to be quite functional, which complicates any claims of insanity.”
Turley further emphasized a warning for those inciting anger and division, indicating that such rhetoric can provoke unstable individuals.
In court filings submitted on Sunday, prosecutors claimed that Cole “just lost his temper” and expressed a desire to punish both political parties due to frustrations stemming from the 2020 election.
Prosecutors argued that the severity of Cole’s actions, combined with overwhelming evidence and a history of deception, made him a risk for future violence. They asserted that no conditions could be set to ensure community safety if he were released before trial.
Turley had previously discussed Cole’s case on December 4 during an appearance on Fox News. It was highlighted that the investigation had remained unresolved for nearly five years until the arrest was made by FBI agents.
“What struck me was the mention of this being an old case, where key evidence had been overlooked. If that’s true, it raises serious questions about the previous administration’s handling of this case,” he stated. “This administration promised to track him down, and it seems they followed through.”
