Judge Issues Temporary Restraining Order on ICE Visits

A U.S. District Judge, Gia Cobb, has implemented a temporary restraining order following a request from twelve Democratic lawmakers aimed at stopping Immigration and Customs Enforcement (ICE) from prohibiting surprise visits by Congress members.

Democrats argue that these unannounced visits are essential for congressional oversight, a stance that the Trump administration previously contested, attempting to restrict such access.

According to a recent ruling, Cobb overturned the Department of Homeland Security’s policy, which mandated a seven-day notice before any visits to detention facilities. Cobb had earlier ruled that certain funds could not be utilized to shut down these oversight visits, but DHS later announced a policy depending on funding from the One Big Beautiful Bill Act, claiming it would sidestep initial discovery issues. The judge found this approach unacceptable.

Colorado Democratic Representative Joe Neguse, one of the lawmakers involved in the lawsuit against the government, expressed his approval via social media. “The court just granted a restraining order against the Trump administration in my case, Neguse et al. v. ICE et al. This decision is a victory for accountability, Congressional oversight, and the American people. I will continue to fight to ensure the rule of law,” he stated.

In a related incident, a Democratic mayor from New Jersey was arrested on trespassing charges during a visit to an ICE facility in Newark. Those charges were eventually dropped. Meanwhile, Congresswoman LaMonica McIver was charged with federal interference for allegedly pushing an ICE officer during the same incident. If convicted, she could face a sentence of up to 17 years.

President Trump has responded to the situation, denying any political motivation behind the charges against McIver. “Give me a break. Have you seen her? She was out of control! She was shoving federal agents. Those stupid days are over! We’ll have law and order!” he commented.

Cobb, the judge overseeing this matter, was appointed by President Biden.
