Judge Overturns Trump’s Wind Project Executive Order
On Monday, Judge Patty Sarris, appointed by Bill Clinton, ruled against an executive order from former President Donald Trump. This order had instructed federal agencies to halt the processing of new or renewed permits for wind energy projects until a thorough evaluation could be conducted.
The executive order had paused new or renewed offshore wind leases across various federal waters. It mandated several agencies, primarily the Interior Department, to assess the environmental and economic effects of such wind projects. Judge Sarris deemed this “Wind Ordinance” unlawful and ultimately invalidated it.
According to the court’s decision, it was concluded that the wind order represented an arbitrary and capricious action, which was counter to legal standards. Thus, the court decided to annul the ordinance and marked it as illegal.
Additionally, while the Trump administration had issued stop-work orders and rescinded permits for certain wind energy initiatives, a judge appointed by President Reagan previously overturned a stop-work order related to the major Revolution Wind project.
In contrast, the Biden administration has advanced wind and solar projects with significant taxpayer funding. A spokesperson from the National Oceanic and Atmospheric Administration remarked that the current administration seemed to bypass environmental assessments, essentially fast-tracking offshore wind initiatives.
Trump has often been critical of wind energy, stating that states investing in windmills and solar energy are experiencing sharp spikes in energy costs.
White House Press Secretary Taylor Rogers commented that under Biden’s policies, offshore wind initiatives received undue advantages, while the broader energy sector faced excessive regulatory restrictions. She noted that Trump’s executive order aimed to reassess wind energy leasing and permitting in light of growing energy demands, economic impacts, and ecological considerations.
Rogers further emphasized that Trump worked to put an end to what she referred to as “Biden’s American energy war,” aiming to restore control over energy resources for both economic and national security reasons.
