Judge Appointed by Trump Overturns Administration's Anti-DEI Orders

Federal Judge Blocks Trump Administration’s DEI Ban

A federal judge decided on Thursday to halt the Trump administration’s attempts to eliminate diversity, equity, and inclusion (DEI) initiatives, as well as racial preferences in educational settings.

This ruling came after litigation initiated by the American Federation of Teachers (AFT), which challenged the Department of Education’s (ED) directives earlier this year. The guidance had sought to inform schools that racial preferences and other DEI strategies were no longer acceptable. The judge pointed out that this guidance would drastically alter the legal responsibilities of schools and could improperly regulate classroom discussions without following the appropriate procedures for such changes.

The court observed that the letter exceeded the limits of interpretation since it brought about major changes to existing laws or policies by imposing new obligations on schools. It stated that this letter needs to be considered a legislative rule if it’s to effectively change the legal landscape.

Neither the Department of Education nor the AFT responded to inquiries about this ruling.

The guidance issued by ED in February didn’t outright prohibit DEI practices but indicated that schools shouldn’t intentionally discriminate based on race, color, or national origin in their activities. It further mentioned that any initiatives categorized under DEI would be assessed individually.

The basis for this guidance was linked to a 2023 Supreme Court decision banning affirmative action policies violating civil rights. Despite this, the administration continued to pursue investigations into alleged discrimination, relying solely on civil rights laws and the Supreme Court ruling rather than the February guidance.
