A California judge said Elon Musk denied Openai's move to halt its efforts to convert it into a for-profit organization, ruling that SpaceX and Tesla CEOs “do not meet the high burden required for the interim injunction.”
The declaration from US District Judge Yvonne Gonzalez Rogers in Oakland comes after Musk filed a lawsuit against Openy and its CEO Sam Altman last year.
Rogers said in her ruling that she is preparing to promote a trial on the matter later this year.
“We look forward to the jury to confirm it [OpenAI CEO Sam] Altman has accepted that he knows he must fully use Musk's charitable contributions for the benefit of the masses, not for his own concentration,” Musk's lawyer Marc Toberoff told Reuters.

Musk, who co-founded Openai in 2015 with Altman, Ilya Sutskever, and Greg Brockman, split from the company in early 2018. Musk founded Openai's competitor Xai in March 2023.
In December 2024, Musk asked the court to stop the transition to a for-profit organization by Openai, the maker of ChatGpt, Reuters reported.

“It's always been about competition,” Openai told the Associated Press in response to the judge's ruling. “Elon's own email shows that he wants to merge his for-profit Openai with Tesla. It was great for his personal interests, but not for our mission or ours.”
Musk filed an unsolicited $97.4 billion bid earlier this year to take over Openai.

“I think he's probably just trying to slow us down. He's clearly a competitor. He's working hard to raise a lot of money. [his startup] Zai and they are trying to compete with us from a technical standpoint, from referencing products to the market,” Altman told Bloomberg at the time, saying, “I hope he competes by building a better product, but I think there were a lot of tactics.
