Mark Gastineau’s Lawsuit Against ESPN Dismissed
Mark Gastineau isn’t one to back down easily, but it seems he’s been met with an unexpected hurdle.
The former New York Jets player had launched a $25 million lawsuit against ESPN regarding a clip from the “30 For 30” series that featured him alongside Brett Favre. However, a judge has dismissed the case with prejudice, as reported by TMZ.
Last March, Gastineau filed the lawsuit after seeing his appearance in the documentary “30 For 30: The New York Sack Exchange,” but the court ruled that he had given written consent for the use of his name and likeness in both the film and its promotional content.
Judge Paul Engelmayer commented that the exchange between Gastineau and Favre highlighted an esteemed NFL record, and he noted how Gastineau’s confrontational demeanor seemed to have caused tension within the famous “sack-exchange” group featured in the documentary.
At 69, Gastineau accused ESPN of airing footage that showed him confronting Favre during a 2023 event. In this video, he claimed that Favre had aided Michael Strahan in breaking Gastineau’s single-season sack record during the 2001 season.
Gastineau expressed through the video, “When you fell for him… You really hurt me. You hurt me, Brett.” It’s clear he felt deeply affected by the situation.
Favre, on the other hand, denied any intentional wrongdoing. He mentioned that he never intended to undermine Gastineau and said that his focus was more about helping Strahan. “I never thought of hurting Gastineau,” he stated in a post last year, adding, “Football is much more business-oriented now than it was when we played.”
In his lawsuit, Gastineau claimed that ESPN used the footage without his consent and that they “maliciously withheld” their handshake from the public. He expressed feeling subjected to “ridicule, belittling, and contempt on social media” due to the portrayal in the clip.
His attorney, Christopher J. Cassar, conveyed that the defendants would be held accountable and highlighted the damage to Gastineau’s reputation spurred by the case.
After the video gained traction online, Favre seemed to empathize with Gastineau, pointing out that having the title of sack king could enhance his marketability and reputation as a speaker.
As for Gastineau, he set the NFL record for sacks during the 1984 season, finishing his decade-long career with 107.5 sacks. He was part of the renowned “New York Sack Exchange,” alongside Joe Klecko and others, but despite being a five-time Pro Bowler and multiple-time All-Pro, he hasn’t received Hall of Fame recognition like Favre or Klecko.
As of now, it remains uncertain whether Gastineau plans to appeal the ruling.
