
A Florida judge has dismissed a lawsuit challenging former President Trump’s handling of classified documents.
Trump faced charges stemming from Special Counsel Jack Smith’s investigation into his possession of classified materials. He has pleaded not guilty to all 37 felony charges brought in Smith’s investigation, including knowingly retaining national defense information, conspiracy to obstruct justice and making false statements.
“Because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution, the indictment is dismissed,” U.S. District Judge Eileen Cannon wrote in a filing Monday and obtained by Fox News.
Earlier this month, President Trump requested a partial stay of the classified documents lawsuit brought against him following a US Supreme Court ruling this week that found the president has broad immunity for official business performed while in office.
Trump’s legal team has asked a Florida court to halt all proceedings in the case until the justices can apply the Supreme Court’s immunity ruling to the facts of the case.
