Judge Dismisses Two Counts Against Trump in Georgia; Fani Willis Lacked Authority

Judge Scott McAfee in Fulton County, Georgia, has dismissed two counts in the county's RICO indictment against former President Donald Trump, ruling that District Attorney Fani Willis lacks standing to bring the charges against him.

Fulton County Judge Scott McAfee ruled that state prosecutors did not have the authority to bring these charges related to allegedly filing false documents in federal court.

McAfee allowed the rest of the case to go forward, including the eight charges against Trump. Trump and 14 co-defendants have pleaded not guilty to organized crime and other charges stemming from what prosecutors say was a scheme to overturn Trump's narrow loss in Georgia in the 2020 election.

The ruling means that five of the 13 criminal counts against Trump that were included in last year's indictment have been dismissed. McAfee filed suit in March. Six other charges were dismissed.Three of those were directed at President Trump.

Last month, after Willis gave a speech that they claimed was racially charged, sparking an ethics complaint, Trump's lawyers asked a state appeals court to remove him from the case on the grounds of “racial animus.”

The ethics complaint was later determined to be substantiated and revealed an inappropriate relationship between Willis and fellow prosecutor Nathan Wade, forcing Wade to resign from the case.

He said the news that the two charges against Trump were dropped marks the former president's latest legal victory in a pattern of political prosecutions against him at both the federal and state levels.

Vice President Kamala Harris tried to use those charges against him during the Sept. 10 presidential debate.
