Tennessee Judge Orders Release of Kilmer Abrego Garcia
A judge in Tennessee has decided to release Kilmer Abrego Garcia while he awaits a federal trial linked to allegations of criminal activity, following the Trump administration’s withdrawal of his deportation to El Salvador.
The Department of Justice is appealing U.S. Magistrate Barbara Holmes’ ruling. The government struggled to demonstrate that Abrego was a flight risk or a danger to the public during the trial period.
In her Sunday ruling, Holmes noted that deciding on Abrego Garcia’s release was somewhat theoretical but emphasized that everyone deserves the presumption of innocence and a thorough assessment of whether he needs to remain in custody prior to trial.
“The court finds no evidence that Abrego’s release poses a clear and present danger to individuals or the community,” she stated.
Upon his release, Immigration Customs Enforcement (ICE) may detain Garcia, a national from El Salvador. Prosecutors indicated during the June 13 detention hearing that ICE could potentially remove him from the country.
The government had the option to expel him to a third nation, but first needed to confirm that this third country would accept him, instead of simply returning him to El Salvador.
Additionally, there were mentions of smuggling fees resulting from a 2022 traffic stop in Tennessee, where Abrego Garcia was driving with nine passengers. Officers had suspicions of smuggling but ultimately let him go with just warnings.
