Judge in Florida suspended following inquiry into inappropriate jokes made while in court

Broward County, Florida, Circuit Court judges are set to face suspension following an advisory board meeting next week. The decision comes after Judge Gary Farmer, a former Florida senator, made what was described as “an exceptionally bad joke,” leading to concerns about his suitability for service and adequacy in attendance.

Filings indicate that an investigation by the Florida Judicial Qualification Committee (FJQC) is underway. Farmer has been put on unpaid leave while awaiting a punishment hearing that has yet to be scheduled.

The suspension takes effect at 11:59 PM on Monday. This follows a recommendation from the FJQC to halt Farmer’s judicial activities.

The investigation targets comments made by Farmer in October 2024, with findings suggesting there are grounds for a hearing in December that could further delve into these matters. The survey revealed numerous instances where Farmer’s remarks strayed into inappropriate territory.

His misconduct is seen as detrimental to public perception of the judiciary, particularly following comments made in relation to a defendant expecting three children with different women. At one point, Farmer joked about the scenario, asking the defendant about the names of the children and making light-hearted yet inappropriate remarks.

In another incident, addressing a separate felony case, Farmer allegedly entertained the courtroom by referencing a comedy sketch that poked fun at various subjects. The court filings highlighted a range of comments that raised eyebrows, indicating a pattern of excessive misconduct over time.

Farmer’s defense, however, argues that these jokes were intended to ease tension in the courtroom. His lawyers suggested that while the jokes might have been risky, they were benign and not meant to offend.

In response to the proceedings, Farmer expressed regret over his past remarks, acknowledging that some were indeed “inappropriate.” Following the suspension recommendation, his legal team has emphasized that he recognizes the humor was misplaced but aimed at fostering a less stressful environment.

The decision has sparked discussions about judicial conduct and the line between levity and professionalism, highlighting the complexities faced by judges in balancing authority with approachability.
