Judge Orders Admission of 12,000 Immigrants Amid Controversy

A federal court has ruled against the Trump administration’s efforts to limit the entry of immigrants, allowing for the resettlement of 12,000 individuals in the United States. This decision comes after the government challenged an earlier injunction.

The Trump administration had originally estimated that only 160 people would be affected by the injunction, but US District Judge Jamal Whitehead criticized this interpretation, describing it as “interpretative jiggery-pokery” aimed at circumventing the law.

“The government cannot freely oppose statutory and constitutional laws, nor the direct orders of this Court and the Ninth Circuit,” Whitehead asserted.

These immigrants are part of the US refugee enrollment program, which President Trump had terminated through an executive order upon taking office in January. Judge Whitehead’s provisional injunction reinstates the program, indicating that the Ninth Circuit holds partial jurisdiction over it. However, the ruling does not extend to individuals who traveled prior to the January 20 order.

The appeals court has yet to clarify the specifics of “conditional recognition,” leading the government to believe it applies to just 160 people. In contrast, Judge Whitehead maintains that it encompasses over 12,000 individuals. He expressed surprise at the disagreement regarding the interpretation of the judicial order, noting the criteria were clearly outlined.

Whitehead also accused the government of “hastily rewriting” the appeals court’s directive. “This court does not entertain the rewriting of the government’s outcome-oriented judicial order,” he stated, adding that while the government has the right to seek clarification from the Ninth Circuit, it must adhere to statutory and constitutional obligations.

To facilitate the process, Whitehead outlined certain criteria that the government must satisfy in the coming weeks to permit the immigrants’ settlement in the US.

The refugee program, established in 1980, operates independently from immigration policies that allow individuals to seek asylum in the country.

It’s noteworthy that Judge Whitehead was appointed to the court in 2023 under the administration of President Joe Biden.
