Judge Halts Deportation of Illegal Alien
Judge Paula Sinis, who was appointed to the US District Court for the Maryland district by former President Barack Obama, has informed Department of Homeland Security (DHS) officials that deporting Kilmer Abrego Garcia is “absolutely prohibited.”
Abrego Garcia was apprehended by Immigration Customs Enforcement (ICE) agents after being released from federal custody, where he faced accusations of human smuggling. The Trump administration had previously considered deporting illegal immigrants to Uganda.
On Monday, Judge Sinis stated that the deportation of Abrego Garcia from the United States is not permitted. “At this point, your client is absolutely banned from being removed from the continent,” she remarked to federal prosecutors. “Is that understood?”
Judge Sinis has ordered Abrego Garcia to remain in the immigration detention center in Virginia, where he is currently held.
Federal prosecutors have proposed a plea deal that would prevent Abrego Garcia from being deported to Uganda, provided he pleads guilty to the charges of human smuggling and acknowledges his deportation to a prison in Costa Rica.
The allegations of trafficking against Abrego Garcia date back to a traffic stop in Tennessee in 2022. Body camera footage shows state troopers pulling him over while he was driving a vehicle registered to Jose Ramon Hernandez Reyes.
Despite having nine individuals in the car, none had luggage, leading officers to suspect that illegal immigrants were being smuggled into the US. However, after speaking with federal agents, Abrego Garcia was allowed to proceed.
Hernandez Reyes, a convicted felon currently serving time in a federal prison in Alabama, was charged in 2020 with multiple counts related to running a human smuggling operation that trafficked illegal immigrants across the border.
During a subsequent interview with the FBI, Hernandez Reyes reportedly stated that he intended to hire Abrego Garcia to assist in smuggling illegal immigrants into the country.
