Judge postpones Abrego Garcia’s release from Tennessee jail due to deportation issues.

Kilmer Abrego Garcia will continue to serve his time in prison as concerns arise from his defense team about the risks of his deportation if he’s released while awaiting trial on human smuggling charges.

His lawyers are requesting a delay in his release based on statements made by President Donald Trump, which they describe as contradictory regarding the fate of individuals from El Salvador. One of the lawyers provided a brief outline in court, emphasizing that the Department of Justice’s statements can’t be taken at face value. They noted the irony of the situation, suggesting that it’s well understood by many.

A spokesperson for the Justice Department, Chad Gilmartin, informed the Associated Press that Abrego Garcia faces serious allegations and that the government plans to proceed with smuggling charges before considering his deportation.

Just hours ago, Justice Department attorney Jonathan Ginn conveyed to a federal judge that Abrego Garcia could be deported to a third country, not El Salvador, although no specific timeline for this action has been established. His defense team pointed to these comments as a reason for fearing a rapid deportation from the U.S.

Abrego Garcia, a construction worker residing in Maryland, became a topic of debate regarding Trump’s stringent immigration policies when he was mistakenly deported to El Salvador in March. This incident led to legal complications, and Abrego Garcia was returned to the U.S. facing smuggling accusations that his lawyers referred to as unfounded.

The defense alleged that the Trump administration’s actions were intended to sway public perception against Abrego Garcia. They argued that, in a just environment, his detention would not be prolonged.

During a recent court session, U.S. Magistrate Judge Barbara Holmes concluded that there was insufficient evidence presented to denote Abrego Garcia as a flight risk or a threat to public safety.

Despite this, concerns over his potential deportation prevented the judge from allowing his release. Abrego Garcia’s legal team requested that any release be postponed until a follow-up hearing scheduled for July 16, which will address a prosecution’s push to reverse his release order. He pleaded not guilty to smuggling on June 13.

The Department of Homeland Security did not provide a direct response to questions raised about Abrego Garcia’s situation. A spokesperson indicated that he would likely face permanent exclusion from the U.S.

Following his deportation by the Trump administration in March, Abrego Garcia was found to have violated a 2019 order from a U.S. immigration judge that prevented him from being sent back to his home country due to credible threats against his safety posed by local gangs.

The current smuggling charges stem from a 2022 traffic incident in Tennessee, where Abrego Garcia was stopped while driving with nine passengers in a vehicle without luggage.
