Judge: RFK Jr. Is Denied Ballot Access In N.Y. Over ‘False’ Address

A judge has ruled that independent presidential candidate Robert F. Kennedy Jr. is ineligible to run in New York state elections because he does not meet the legal requirements for New York residency.

Judge Christina Ryba said the independent candidate’s claim of a New York address as his place of residence in his petition was a “false statement.”

As a result, the petition was deemed invalid. Kennedy rejects the judge’s decision and has vowed to appeal.

The ruling not only blocks Kennedy from running for office in New York, but also opens up legal disputes in other states where he lives.

Kennedy pointed out that the justices are Democrats and rejected the decision, calling it a political attack.

“They’re not confident they can win the vote, so they’re trying to deny voters a choice,” he said. “We’ll appeal, and we’ll win.”

Kennedy, 70, argued in court that he had lived in New York since he was a child and planned to return when his wife, actress Cheryl Hines, retired from acting. He moved to California to be with her in 2014, where he still lives today.

Kennedy claimed in court that he rented out a bedroom in Katonah, New York, about 40 miles north of Manhattan.

His friend, Barbara Moss, from whom he is renting the apartment, told the court she was charging him $500 a month, adding that the rental agreement was not in writing.

Additionally, Kennedy provided proof of residency by demonstrating that he practices law in New York state and pays taxes there.

But in his 34-page ruling, Judge Leiber argued that “the overwhelmingly credible evidence presented at trial” provided the sole basis for Kennedy’s New York speech.

“Given the size and appearance of the spare bedroom depicted in the photographs introduced into evidence, the court finds it highly unlikely or even outrageous to suggest that Mr. Kennedy might return to that bedroom to live with his wife, family, multiple pets and all of his personal belongings,” the judge wrote.
