Federal Intervention in DC Police Department
Recently, Attorney General Pam Bondy made a significant move by appointing DEA Principal Terry Cole as the “Emergency Police Chief” for the District of Columbia’s Metropolitan Police Department. This decision, interestingly, bypassed both Mayor Muriel Bowser and Police Chief Pamela Smith. The directive also emphasizes collaboration with federal immigration authorities.
In reaction to this, Mayor Bowser along with DC Attorney General Brian Schwarb has taken legal action, claiming the appointment violates the 1973 DC Home Rule Act, which safeguards the district’s local governance, particularly regarding its police force.
“By executing what can be seen as a hostile takeover of the MPD, the administration is undermining the district’s right to govern itself, potentially jeopardizing safety for residents and visitors alike,” Schwarb commented. “This is a serious affront to the dignity and autonomy of DC’s 700,000 residents, and we are committed to challenging it.”
Following this, U.S. District Judge Ana C. Reyes stepped in, suggesting a potential compromise. She permitted Cole to request services from the MPD but limited his authority to direct or invalidate local leadership. Cole now must route requests through the mayor. The judge indicated that if the Justice Department did not adjust Bondy’s order by Friday evening, she would impose a temporary restraining order to halt any claims from authorities.
Later, the DOJ consented to modify the order, at least for the time being, aligning with the judge’s conditions. However, a key question remained: Can President Donald Trump command DC police officers to enforce immigration regulations? This matter is anticipated to be resolved in the following week.
Under Bondy’s earlier order, Cole had been granted authority over the DC Police Department, which also nullified local policies that limit collaborations with federal immigration enforcement.
By the conclusion of Friday’s court hearing, DOJ Prosecutor Yakov Ross announced that key elements of Bondy’s directives would be amended, ultimately removing Cole’s designation as police chief. City officials conveyed that they would strip Smith of her responsibilities if the situation escalated.
Citing Section 740 of the District of Columbia Home Rules Act, it allows the President to place the MPD under federal oversight during “special terms of urgency” for up to 48 hours without congressional notification. After that period, the President must inform the leaders of the District Senate and House Committee. This federal administration could last up to 30 days unless Congress intervenes.
Alongside this police intervention, the administration has also deployed the DC National Guard to assist local law enforcement efforts.
As the DOJ agreed to modifications, Cole would now be considered a liaison who can only request help from the MPD through the mayor.
Analysts suggest that the situation reflects broader struggles over DC’s limited autonomy and poses significant questions about the extent of federal authority in the nation’s capital.
In the midst of the ongoing situation, Mayor Bowser traveled to Martha’s Vineyard, indicating she had left Washington D.C. as President Trump implemented federal measures. Her office explained that she needed to welcome her young daughter, justifying the trip. However, critics claimed she was shirking her duties, using her child as an excuse.
“The mayor had a family commitment and needed to be with her daughter,” stated her office. “She’ll return to the district tomorrow.”
While the mayor emphasized that she continued to manage DC during her absence, stating she remained in constant contact with her team and partners, her critics weren’t convinced.
“I’m in regular contact with my senior team, constantly consulting and keeping up with what’s happening back in the district,” Bowser posted on social media. She also pointed out that she had previously canceled a family vacation due to the ongoing issues.
