This week, a five-day preliminary hearing is underway, where prosecutors need to persuade District Judge Tony Graff that there is sufficient evidence to move forward with aggravated murder charges against Tyler Robinson, the suspect in the assassination attempt on Charlie Kirk.

It appears the prosecution has presented a significant amount of evidence, making it a demanding task for the defense to respond adequately.

A source involved in the investigation mentioned, “The shoes were the same, and I saw Mr. Robinson on the video; it really looked like the same person.”

During Monday’s proceedings, Judge Graff inquired about various aspects, including Robinson’s supposed “sniper’s pad,” which was reportedly on the roof of the Rothesay Center building, a location with a clear view of the area at Utah Valley University where Kirk was attacked. Evidence, including a screwdriver alleged to contain Robinson’s DNA, was recovered from the scene. The judge also viewed graphic footage of the incident that visibly affected him.

On Tuesday, the court watched a compelling video that the defense had attempted to keep out of the proceedings. David Hull, a former agent with the Utah Bureau of Investigation overseeing the assassination investigation, shared a compilation of surveillance footage detailing Robinson’s activities on September 10.

  • Hull indicated that the video appears to depict Robinson arriving at a parking lot, dressing in specific clothing, including Converse shoes and a maroon T-shirt, and engaging with Turning Point USA representatives on campus before leaving.
  • Robinson, still in the same outfit, was later recorded walking back to campus, where he went to a nearby fast food restaurant.
  • After eating, he then ventured to a wooded area, changed clothes, and approached the roof access point of the Rothesay building, notably limping and carrying what seemed like a bulky item.
  • Moments prior to the shooting, he was seen climbing up to the roof before taking a position designed for firing, lying face down as police responded to the scene.
  • He exited the rooftop area, running into the grass while clutching an object.

Hull shared his observations regarding the suspect’s clothing, reiterating, “The shoes were the same; it’s the same person in my view.” He also admitted that while the rooftop footage did not provide clear facial features, it nonetheless illustrated a coherent account of Robinson’s movements on that critical day.

Further, prosecutors displayed footage of Robinson’s encounter with a Spanish Fork police officer on September 11, the day following the shooting. The officer took note of Robinson’s license plate, which led to the discovery that the vehicle was registered to him and his mother.

The evidence presented included enhanced video segments to aid the court in understanding the various contexts within the footage.
