The 12 jurors have been unable to reach a unanimous decision on the manslaughter charge of Daniel Penny.

A jury on Friday struggled to reach unanimous agreement on whether to convict Penny of “recklessly” killing Jordan Neely after strangling her for six minutes on the subway in May 2023. I sent a memo saying.
Lawyers representing Penny said the 26-year-old Marine was protecting fellow subway passengers from Neely, who yelled, “Someone's going to die today!” When he rode the F train uptown.
They also say there is no evidence beyond a reasonable doubt that strangulation caused Neely's death.
Manhattan prosecutors, meanwhile, said Neely never threatened anyone in particular, didn't have any weapons, and only had a muffin in his pocket.
A hung jury first began deliberating early Tuesday afternoon.
If they can't reach a verdict, Manhattan Supreme Court Justice Maxwell Wiley will have to impose “Allen” charges on them. Mr. Allen's charges urge jurors to reconsider their positions in an effort to find unanimous agreement.
Penny faces up to 15 years in prison if convicted of manslaughter. If convicted of the lesser charge, he could face up to four years in prison.
