James Comey and Letitia James Face Federal Criminal Charges

Federal prosecutors have indicated their intention to potentially replace James Comey’s lead defense attorney due to concerns over conflicts of interest stemming from Comey’s previous disclosures post his firing by President Donald Trump in 2017.

Prosecutors pointed out Comey’s longstanding connection with his lawyer, Patrick Fitzgerald, suggesting this relationship could affect his defense. They specifically noted Fitzgerald’s role in Comey’s disclosures during Trump’s administration, which raises questions about possible biases and inconsistencies.

Prosecutors questioned the suitability of Fitzgerald as the defense attorney, especially given their prior collaboration as federal prosecutors in New York.

In an interesting twist, Comey is actually seeking to have his criminal case dismissed, arguing that the prosecutor assigned to his case was illegally appointed.

On a related note, prosecutors urged U.S. District Judge Michael Nachmanoff to expedite the formation of a “filter team” of lawyers. This team’s job would be to sift through materials relevant to Comey’s case, particularly those that might have attorney-client privilege implications.

According to court filings, the filter team could shed light on Fitzgerald’s involvement in how Comey shared information after leaving the FBI, including material that had been protected by privilege.

The federal attorneys also stated that, based on available information, Comey allegedly used his lead defense attorney to unlawfully disclose private information.

Meanwhile, Comey’s legal team quickly contested the Justice Department’s request for expedited review processes. They emphasized that the memo Comey shared with his lawyers wasn’t classified at the time of distribution, implying that the claims of misconduct were unfounded.

They described the allegations against Comey and Fitzgerald as “patently false” and indicated that there was no legitimate reason to claim a conflict of interest in having Fitzgerald represent Comey.

Fitzgerald represents Comey among several high-profile attorneys in the criminal case initiated last month in Virginia, where Comey faces charges related to false statements and obstruction.

Notably, a 2019 report from the Department of Justice had previously criticized Comey for sharing details about his interactions with Trump but found no evidence of him leaking confidential information to the media. The report also did not result in any criminal charges against Comey.

As the case unfolds, the Justice Department’s motion aims to set the stage for a scrutinized legal battle against Comey, who has been challenging not only the charges but also the recent appointment of former White House aide Lindsey Harrigan as acting U.S. attorney for the Eastern District of Virginia.

Harrigan’s appointment occurred right before the grand jury proceedings, and Comey’s lawyers have suggested this could bolster their request to dismiss the case, calling the prosecution “vengeful.”
