Justice Department submits official complaint against Judge Boasberg

The Justice Department has formally requested that US District Judge James Boasberg be excluded from a prominent deportation case, alleging misconduct. This action on Monday intensifies the ongoing tensions between Boasberg and President Trump.

Boasberg has faced criticism from Trump for some time now, but the latest letter from the Justice Department escalates matters, suggesting the need for investigations into Boasberg’s actions and possible disciplinary measures.

In a five-page complaint, Attorney General Chad Mizzell noted, “Judge Boasberg’s actions have undermined the integrity of the judicial system and public confidence,” as reported by Hill.

The filing claims Boasberg discussed sensitive issues with another judge during a Judicial Council meeting back on March 11. A conservative outlet, Federalists, previously reported that Boasberg expressed concerns about the administration possibly ignoring federal court decisions, which could lead to a constitutional crisis.

The Justice Department’s new complaint states that Boasberg, appointed by former President Obama, is failing to fulfill his ethical duty to uphold public trust in the judicial process by making public comments on ongoing cases.

“These remarks undermine judicial integrity, and we cannot condone this,” wrote Attorney General Pam Bondy.

The complaint has been directed to Sri Srinivasan of the DC Circuit Court of Appeals. Federal law allows for the possibility that Srinivasan has either dismissed the complaint or has taken appropriate steps in response.

The Hill sought a comment from Boasberg through a court representative.

Boasberg is currently facing considerable backlash from Trump’s supporters, particularly related to a legal challenge concerning the president’s enforcement of laws aimed at expelling Venezuelan gang members in El Salvador. Shortly after the Judicial Council meeting, he was assigned a case where he ordered a flight diversion, but the Supreme Court later overturned his decision, ruling that the immigrants had initiated their lawsuit in the wrong jurisdiction.

Following this, Boasberg accused the Trump administration of intentionally ignoring his ruling, while the appeals court postponed the lawsuit for several months.

The latest complaint from the Justice Department seeks to expedite investigations regarding Boasberg. It warns that if “willful misconduct” is confirmed, Boasberg should face accountability or further disciplinary recommendations.

“Quick action is essential to uphold the integrity of the judiciary, demonstrating that judges are held to the same standards as others,” Mizzell emphasized.
