Kevin Costner’s Legal Situation Regarding Stunt Performer Lawsuit
Kevin Costner has achieved a legal win in a lawsuit concerning sexual harassment brought by stunt performer Devin LaBella. LaBella had accused him of pressuring her into an unscripted, unplanned rape scene while filming his western series “Horizon.” Costner, on his part, has strongly denied these claims. He attempted to get the entire lawsuit dismissed but was met with a mixed response from the judge. While the judge upheld eight of LaBella’s claims, two were dismissed, as reported by legal documents obtained from TMZ.
Specifically, one of the dismissed complaints involved allegations of sexual harassment, and the other concerned supposed breaches of the Bain Act, which pertains to hate crimes. Costner’s attorney, Marty Singer, expressed satisfaction with portions of the court’s decision, stating, “We were pleased to learn that the court partially granted our anti-SLAPP motion and dismissed two of the plaintiffs’ claims, including one sexual harassment claim.”
However, the attorney also conveyed disappointment regarding the claims that remain. “While we are disappointed in the court’s decision to allow her remaining counts to proceed, it is clear that the evidence lacks legal or factual merit, and we plan to immediately appeal the court’s decision,” Singer stated.
He further elaborated, asserting that, despite the plaintiff’s accusations, there was never any form of “mock rape” or “mock sex,” nor was there any retaliation involved. According to him, the plaintiff aims to secure millions for what he characterized as a harmless one-shot rehearsal she had acknowledged was briefed beforehand.
“We will continue to fight for the truth and we are very confident that we will prevail,” he concluded.
