The Virginia school district faces backlash after accusing two boys of sexual harassment for complaining about a transgender classmate in the boys’ locker room. This situation escalated to federal court after their appeal was denied.
Loudoun County Public Schools initiated a Title IX investigation earlier this year following a video incident involving a transgender woman in the boys’ locker room. In the footage, the boys were seen expressing discomfort over a girl using their facilities.
As a result of the investigation, both boys were found guilty of sexual harassment, marked on their permanent records, and received a 10-day suspension. The boys’ families sought legal help after the district upheld its ruling against them, but their appeal was recently rejected.
One of the boys’ lawyers stated, “The district’s denial tarnishes the reputations of these innocent boys based on unsupported accusations of Title IX violations. They should have been shielded—these are just second-grade students.” The Free Speech Law Center and America First Legal will assist the families in their legal fight.
The press release noted that future lawsuits in the federal division will demand the removal of these false Title IX claims from the boys’ records, highlighting the emotional and reputational damage inflicted upon them and their families.
The boys’ father, Seth Wolf, expressed his concerns, saying, “This isn’t just about our son; it’s about all children in Loudoun County. If the district can weaponize Title IX this way, no family will feel secure.” Meanwhile, Renae Smith, the mother of another boy involved, shared that her family moved out of state due to the fallout of the incident, stating, “Our boys should be focusing on their education, not battling baseless accusations.”
Recently, both parents addressed the lack of clear communication and support within the school district regarding transgender policies. According to their accounts, the boys aimed to voice their discomfort but felt unheard by the authorities.
Now, with America First Legal joining their cause, the families are gearing up for the next phase in federal court. Many view this situation within the larger context of the ongoing debates about transgender rights in schools, particularly as Loudoun County Public Schools faces scrutiny from the Department of Education over its policies.
